Waiver And Release For Live Broadcast
In consideration for admission to the boxing match taking place at Cache Creek Casino Resort, located at 14455 Hwy 16, Brooks, California, on April 7, 2023 ("The Event") and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Holder of this ticket: (1) hereby releases, indemnifies, and holds harmless Cache Creek Casino Resort ("CCCR"), the Yocha Dehe Wintun Nation, Paco Presents Boxing LLC ("PPB"), ShoBox, Showtime, and each of their parent or subsidiary entities, and their respective officers, directors, employees, and agents (collectively, "Recipients"), from any and all liability for loss or damages to person or property; (2) agrees to comply with all rules and regulations of CCCR and PPB; (3) voluntarily assumes the risk of danger and personal injury and all other hazards arising from or in any way relating to Holder's attendance at The Event, whether occurring prior to, during, or after The Event, including, but without limitation, any claims for personal injuries resulting from or arising out of the negligence of any of the Recipients; (4) warrants that Holder is authorized to grant the rights and give the releases set forth herein; and (5) consents to be photographed, filmed, and/or otherwise recorded while attending The Event, a live broadcasted sporting event. Holder grants to Recipients the right to publicly or privately televise (directly or by means of a recording that may be used at a later date), broadcast, use and re-use, or disseminate by any medium now existing or hereafter developed (including, without limitation, live TV, free-TV, Satellite-TV, Cable-TV, Pay-Per-View, Internet transmissions, and home video) or license others to do so (collectively, to "Use"), all or any part of Holder's attendance (the "Attendance") at The Event, including Holder's name, voice, photograph, actions, likeness, physical appearance, attire, and personal facts ("Holder's Depiction"). The Attendance and Holder's Depiction may be edited by the Recipients for Use in advertising, merchandising, publicity, and promotion relating to The Event. By holding and using this ticket, Holder represents that Holder is at least 21 years of age. This ticket may be withdrawn at any time for any reason, or no reason, and admission to The Event may be refused for any reason, or no reason, including, without limitation, breach of any of the foregoing representations made by Holder. Nothing contained herein shall obligate CCCR or PPB to actually use all or any part of Holder's Depiction.
